Current status: not legal, but moving

Online casino gaming is not yet legal in New York, but it's an active legislative topic. The state has shown with mobile sports betting that it will expand digital gambling when the revenue case is strong enough — and iGaming is projected to raise substantial tax dollars currently flowing to the offshore New York online casinos New Yorkers use today.

New York online gambling timeline

  • Nov 2013 — voters approve Proposal 1, creating the commercial-casino framework.
  • Apr 2021 — mobile sports betting authorised through the state budget.
  • Jan 2022 — mobile sports betting launches; NY becomes the largest US market.
  • 2022–2025 — Sen. Addabbo introduces successive iGaming bills (S8412, then S2614 with Assembly companion A6027).
  • Jun 2025 — AG Letitia James acts against 26 sweepstakes operators.
  • Dec 2025 — Gov. Hochul signs S5935A, banning sweepstakes; three downstate retail licences awarded.
  • 2026 — iGaming bills reintroduced; still in committee.

What's blocking legalisation

Three things, mainly: protecting retail and tribal casino revenue and the compacts that govern it; responsible-gambling concerns from some legislators; and sequencing — the downstate retail casino rollout is widely seen as the priority that comes before online. Supporters counter that regulated iGaming would capture tax revenue and add consumer protections the current offshore market lacks.

Realistic timeline

If a bill clears in a 2026 session, a regulated launch in 2027 is the optimistic case — licensing, rule-making and operator onboarding take many months after a law passes. Until then, the New York online casinos listed on this site remain the only real-money option. We update this page as bills move.

NY online casino legalisation — FAQ

When will online casinos be legal in New York?
No date is set. Bills to legalise iGaming (most recently S2614) keep being introduced but none has passed. The earliest realistic launch, if a bill passes in a 2026 session, is 2027.
Who is pushing to legalise online casinos in NY?
State Senator Joseph Addabbo, chair of the Senate Racing, Gaming and Wagering Committee, is the main sponsor. He cites the success and tax revenue of legal mobile sports betting.
Why hasn't New York legalised online casinos yet?
Concerns include cannibalising retail casinos and tribal gaming compacts, problem-gambling worries, and competing budget priorities. The downstate retail casino licences awarded in late 2025 are seen as a step that comes first.
